These Terms of Service ("Terms") govern your use of CostGoat, a desktop application for real-time cost monitoring of cloud services, APIs, and subscriptions ("Service"), operated by FUNCTIONCRAFT - FZCO, a company registered in the United Arab Emirates ("we," "us," or "our").

By downloading, installing, or using CostGoat, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

1. Service Description

CostGoat is a privacy-first desktop application that provides:

• • Real-time monitoring of cloud service costs and usage
• • API credit and usage tracking
• • Subscription management and renewal tracking
• • Budget alerts and threshold notifications
• • Direct integration with service provider APIs

The Service operates locally on your device, making direct API calls to your connected services. We do not process or store your actual cost data on our servers.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• • Download and install CostGoat on devices you own or control
• • Use the Service for personal or business purposes
• • Access updates and new features during your license period

Licenses are issued on a per-user basis. Each user requires their own license, which may be used on multiple devices owned by that user.

3. Trial and Subscription

3.1 Free Trial

CostGoat offers a 7-day free trial with full functionality. No credit card or sign-up is required to start the trial. The trial automatically expires after 7 days unless you purchase a license.

3.2 Pricing Plans

• • Yearly License: Billed annually, includes all features and updates for the subscription period
• • Lifetime License: One-time payment, includes all features and lifetime updates
• • Enterprise License: Custom pricing for organizations, calculated based solely on the number of users

3.3 Payment Processing

All payments are processed by Paddle.com Market Limited ("Paddle"), our Merchant of Record. Paddle handles all payment processing, tax collection, and compliance. Your payment relationship is with Paddle, not directly with us.

4. User Responsibilities

You agree to:

• • Provide accurate information when purchasing licenses
• • Maintain the security of your license keys and API credentials
• • Use the Service in compliance with all applicable laws
• • Not share, resell, or redistribute your license
• • Not reverse engineer, decompile, or modify the software
• • Comply with the terms of service of integrated third-party services

5. Privacy and Data

Your privacy is fundamental to our Service. Please review our Privacy Policy for detailed information about data handling. Key points:

• • All cost data processing happens locally on your device
• • API credentials are stored securely using your operating system's native keyring
• • We only collect minimal data necessary for license management
• • Optional team sharing uses end-to-end encryption

6. Intellectual Property

CostGoat and all related trademarks, logos, and software are owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except as expressly stated.

Third-party service names and logos are the property of their respective owners. Our use of these marks does not indicate endorsement by or affiliation with these services.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• • The Service will be uninterrupted or error-free
• • Cost calculations will be 100% accurate at all times
• • Third-party services will remain available or compatible
• • The software will be free from bugs or vulnerabilities

Cost data displayed in CostGoat is based on information from third-party APIs and should be verified against official billing statements.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims related to these Terms shall not exceed fifty US dollars ($50).

These limitations apply regardless of the theory of liability and even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if:

• • We discontinue the Service
• • Required by law

Upon termination, your license to use the Service ends immediately. Lifetime licenses remain valid unless terminated for violation of these Terms.

11. Refund Policy

Refunds are handled by Paddle according to their refund policy:

• • Yearly subscriptions: 30-day money-back guarantee
• • Lifetime licenses: 30-day money-back guarantee
• • Enterprise licenses: As specified in your agreement

12. Governing Law and Disputes

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms shall be resolved through good faith negotiation.

If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of the Dubai International Arbitration Centre (DIAC). The arbitration shall be conducted in English in Dubai, UAE.

13. Changes to Terms

We may update these Terms from time to time. You should check this page periodically for changes. For material changes that significantly affect your rights, we will make reasonable efforts to notify you.

Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

14. General Provisions

14.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
